contractual issues and dispute resolution

Paul Whitley is a qualified Arbitrator with a growing list of live construction industry arbitration cases both in Contractor/Employer and Architect/Client disputes. He has also acted as expert witness, and as the employer claimant in various adjudication, arbitration and litigation proceedings. He is well versed in the intricacies of the growing field of adjudication and EUA maintain a library in-house of current legal commentary and emerging precedent. EUA work with a range of leading legal firms and Counsel in the UK on a regular basis.


Arising out of the above experience, EUA have a particularly extensive knowledge of construction contracts and the implications of various aspects contract drafting.


EUA advise and assist clients' legal representatives on the drafting and amendment of contracts to achieve the best results for clients. Examples would include Guaranteed Maximum Price, identification and transfer of risk, affects of acceleration clauses and damages regimes.

As the Secretary of the Foundation for International Commercial Arbitration and Alternative Dispute Resolution, (an international charitable foundation with its seat in The Hague) Paul Whitley assists with setting up training courses in arbitration and other forms of dispute resolution in the developing world. In November 2002, at an international colloquium held in New Delhi, he shared a platform with the Chief Justice of India and the ex-President of the International Council for Commercial Arbitration and presented a lecture on the application in the English Courts of the Arbitration Act 1996.

In April 2005, Paul presented a paper at the Spring Conference of the European Branch of Chartered Institute of Arbitrators. In this he presented an introduction to the Indian Arbitration and Conciliation Act and attempted to explain the situation of arbitration in that country.

Later in that year, in July, Paul was invited to speak at an RICS-sponsored event when he presented his observations relation to some provisions of Polish law on Arbitration with the UNCITRAL Model Law and the New York Convention 1958.
